30 Jun 2023 A special civil application No SCA 17833of 2018 filed by KWA is pending before the Honorable High Court of Gujarat Challenging the Arbitration proceedings by the Sole Arbitrator appointed by Gujarat chamber of Commerce and Industry Company. Meantime the Petitioner M/s Modern Construction Company filed a New application on 25-04-2021, before the GCC for interim relief under sec 17 of the Arbitration and conciliation act,1996 of DP-19 &GCCI ADRC case. Arbitration meeting was held on 8-05-2021 and the Honorable Mr Justice C K Buch (Rtd),Sole Arbitrator passed order that, ”till hearing and disposal of the present application-in the meantime, parties before the tribunal shall maintain status quo-as on date to the execution of contract in question. Hence as per the legal opinion received from CLO , further proceedings on arrangements of balance Work is kept pending until a decision is made. After a series of Arbitral hearings , a proceeding dated 11/2021 was received through e mail on 23-11-2021 and as per this, the interim protection granted has vacated by the Tribunal and stated that the work under contract requires to be completed is in ultimate interest and benefit of large number of people of a city of State of Kerala i.e Thiruvanthapuram. If the status quo granted if continued, and the contract between the parties is treated in existence, it may cause serious prejudice and inconvenience to the people as the work is of laying down water pipeline would remain hanging.Work arranged for the balance Work for Pallithura area under Risk and Cost and work started. Tendered the balance works in Thirumala Thrikkanapuram Road and the work order issued. Termination Order of the Original work WP1 is No.KWA/JNNURM-PIU/WS-27/09/DI dtd 03-03-2020 of the Project Coordinator, JNNURM PIU, Thiruvananthapuram. Construction of valve chambers were completed at Kunnapuzha Jn. and Puthenkadamukku Jn. MS fabrication work on both side of the Trikkannapuram Bridge has been completed. Interconnection works were completed and suitable valve chambers were constructed at Sree hills lane, Jai nagar , Plavila Junction, Plavila Jn (near bank) , Anayidavazhi road, Vaaliyakkattaikkal road,Aramada society road Ani company road, and Aramada park Jn. There is an existing valve chamber at Aramada MLA Jn. So interconnection works were only done there. Work completed and final bill submitted for supplying and fixing valve chambers work. A gap and nonalignment has found between 300mm and 500 mm DI pipe at Plangalamukku during earthwork for valve fixing in commissioning of DI pipeline work. So 300 mm MS pipe was fabricated and joined with 500 mm DI pipe. Construction of valve chamber completed at Plangalamukku and heavy duty covers fixed. Scour valve of 150 mm fixed after Trikkannapuram bridge. Air valve fixed at Puthenkadamukku and Kunnapuzha Jn. Earth leveling completed. Thiruvananthapuram Project AE9
